The petitioner was appointed as Shiksha Mitra and her appointment continued from session to session. She was married on 30.4.2008 and when after marriage she wanted to resume her duties she was not allowed to join. She represented to the authorities. The representation of the petitioner has been decided by the impugned order dated 11.1.2010 pursuant to the direction of the Court in an earlier Writ Petition No.69221 of 2009 filed by the petitioner. The representation of the petitioner has been rejected on the ground that the petitioner had absented herself without taking leave in connection with her marriage and, as such, she is not entitled to any relief.
The submission of learned counsel for the petitioner is that a new case with regard to absence without taking leave has been made out, though in the representation of the petitioner the only issue involved was as to whether until and unless the petitioner resigns after marriage she is entitled to continue or not. Thus, on the ground on which she has been non suited she has not been afforded any opportunity of hearing.
Learned Standing Counsel prays for and is allowed a month's time to file counter affidavit. Two weeks thereafter are allowed to the petitioner for filing rejoinder affidavit.
