This application has been filed by the applicants (original petitioners) with the following prayers:
"(a) This Hon'ble Court be pleased to restrain the GIDC - respondent herein from making allotment of any of the commercial plots in Vapi Industrial Estate at Valsad.
(b) Pending admission, hearing and/or final disposal of this application, the respondents be directed to take into consideration the name of the applicant as land loser and only after incorporating the name of the applicant, the policy of the GIDC to allot land to the land loser be adopted and till then no proceedings be undertaken by GIDC for allotments of land.
(c) This Hon'ble Court be pleased to forthwith try the petition namely, SCA No.10727/2000 and be pleased to allow the same.
(d) Such other and further reliefs as this Hon'ble Court may deem just, fit and expedient be granted in favour of the applicant."
At the outset, Mr.Y.H.Vyas, learned advocate for the applicants submits that at this stage, he is not pressing any other prayer, except part of Prayer made at Paragraph 5(c), namely, to hear the main petition at an early date.
Heard Mr.Y.H.Vyas, learned advocate for the applicants, Mr.Neeraj Soni, learned Assistant Government Pleader for respondent No.1 and Mr.Chinmay M.Gandhi, learned advocate for respondents Nos.2 and 3, and perused the averments made in the application.
In view of the statement made by the learned advocate for the applicants that at this stage, he does not press any other prayer made in the application, except the prayer to hear the main petition being Special Civil Application No.10727 of 2000 at an early date, the following order is passed:
Special Civil Application No.10727 of 2000 be listed for final hearing on 05.04.2012.
The application is disposed of in the above terms.
