The order dated 10.5.2012 reads as under:
"Learned advocate for the petitioner would submit that respondent-husband is in arrears of Rs.2,00,000/- approximately towards maintenance, as ordered under Section 125 of the Code of Criminal Procedure, 1973, and arrears towards rent of Rs.4,000/- awarded by the learned Magistrate under provisions of Protection of Women against Domestic Violence Act, 2005, is to the tune of Rs.1,38,000/-.
Issue bailable warrant to the sum of Rs.5,000/- against respondent-husband returnable on 22nd May, 2012 so as to secure his presence."
On 22.5.2012, no compliance was reported and today when the matter is listed for further hearing, learned advocate for the respondent-husband submits that he was sick and unable to pay arrears as ordered by the Court below and needs some time.
The respondent-husband is in arrears and the amount is due since last few months which is approximately to the tune of Rs.1,38,000/-.
In spite of bailable warrant issued earlier, he is not present in the Court and accordingly Non-Bailable Warrant in the sum of Rs.5,000/- be issued against respondent-husband returnable on 1.6.2012. Registry to communicate this order through the in-charge police officer of the area in which the respondent-husband resides.
