The order dated 10.5.2012 reads as under:
"Learned advocate for the petitioner would submit that respondent-husband is in arrears of Rs.2,00,000/- approximately towards maintenance, as ordered under Section 125 of the Code of Criminal Procedure, 1973, and arrears towards rent of Rs.4,000/- awarded by the learned Magistrate under provisions of Protection of Women against Domestic Violence Act, 2005, is to the tune of Rs.1,38,000/-.
Issue bailable warrant to the sum of Rs.5,000/- against respondent-husband returnable on 22nd May, 2012 so as to secure his presence."
SCR.A/1435/2010 2/2 ORDER On 22.5.2012, no compliance was reported and today when the matter is listed for further hearing, learned advocate for the respondent-husband submits that he was sick and unable to pay arrears as ordered by the Court below and needs some time.
The respondent-husband is in arrears and the amount is due since last few months which is approximately to the tune of Rs.1,38,000/-.
In spite of bailable warrant issued earlier, he is not present in the Court and accordingly Non- Bailable Warrant in the sum of Rs.5,000/- be issued against respondent-husband returnable on 1.6.2012. Registry to communicate this order through the in- charge police officer of the area in which the respondent-husband resides.
