A policy has been introduced by the State of Uttar Pradesh to provide pension to the Lok Tantra Rakshak Senani. As per policy introduced, persons who were detained in prison for political reason during period of internal emergency i.e. from 25.06.1975 to 21.03.1977 are entitled for pension. From among persons mentioned above, if anyone is died then his/her spouse will be entitled for such pension. As per the petitioner, her husband was sent to jail due to political reason during emergency and expired on 31.10.1992, therefore, she is entitled to have pension. As per policy introduced by the State of U.P., it is also stated by the petitioner that at least nine persons similarly situated are getting such pension. Before approaching this Court the petitioner submitted an application for grant of pension as per Government Policy to the District Magistrate, Mau but of no consequence.
Having considered all relevant facts, we deem it appropriate to dispose of this petition for writ by directing the District Magistrate, Mau to consider and decide the claim of the petitioner to have pension as per provision of Lok Tantra Rakshak Senani Pension Rules, 2013 within a period of six weeks from the date when the petitioner presents a certified copy of this order along with a detailed representation before him.
The petition for writ stands disposed of.
