By means of this writ petition, the following relief has been prayed for -
"To issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 i.e. Tehsildar, Tehsil-Sadar, District- Mau to expedite the hearing of the Restoration Application/Recall Application/Tajabijsani Application No. 3 of 2017 under Section 151, order 9, Rule 13 C.P.C. of the U.P Revenue Code, 2006 (Moti versus Sushila and others) and to decide the aforesaid case within prescribed/stipulated period, as directed by this Hon'ble Court."
It has been submitted that a restoration application filed against the mutation order passed in favour of the petitioner is pending consideration and that an interim order staying the mutation order in favour of the petitioner is also operating therein. This restoration application is pending since the year 2017.
In the aforesaid facts and circumstances, this writ petition is disposed of with the direction that the respondent no. 2 Tehsildar, Tehsil-Sadar, District-Mau may endeavour to decide the restoration application expeditiously, preferably within a period of two months from the date a certified copy of this order is filed before him.
