Heard learned counsel for the petitioners and learned Standing Counsel.
Learned counsel for the petitioners submitted that after death of Krishna Srivastava @ Krishan Murari Lal, name of petitioner no. 1 (wife) and petitioner no. 2 (son) were mutated in Khatauni record vide order dated 17.10.2014 in which respondent no. 3 has filed objection along with stay application upon which vide order dated 28.11.2018, respondent no. 2 has stayed the order dated 17.10.2014 and till then proceeding is pending. It is next submitted that as per Rule 34 (7) of U.P. Revenue Code, 2016 maximum limitation for deciding the objection is three months, therefore, a suitable direction may be issued to respondent no. 2 to decide the objection filed by respondent no. 3 within time prescribed for which learned Standing Counsel has no objection.
Accordingly, the petition is disposed of with direction to respondent no. 2 to decide the objection of respondent no. 3 after considering the reply of objection by the petitioners, maximum within a period of three months from the date of production of computer generated copy of this order after verifying the same from Official Website of Allahabad High Court.
