Parties agree that the order dated 31.3.2010, dismissing the application filed by the petitioner, challenging the allotment of land in question to the respondent nos. 4 to 11, has been dismissed without considering the fact that the ceiling proceedings had come to an end and an order has been passed in favour of the petitioner by the Prescribed Authority. The parties agree that the matter may be relegated before the Commissioner for decision afresh after hearing the parties.
On the basis of the said submission made at the bar, the order dated 31.3.2010 is set aside. The Commissioner is directed to decide the application filed by the petitioner and any other application that may be filed after hearing affected parties in accordance with law taken into account the subsequent development that have taken place in between the parties.
The writ petition is disposed off in terms of the order passed above.
