Heard Sri P.R. Maurya, learned counsel for the petitioner and learned Standing Counsel for the respondents-State.
The petitioners claim to be working as Lecturers in the Rajkiya Balika Inter College Saiyed Raja, Chandauli and Aaditya Narayan Rajkiya Inter College, Chakiya, Chandauli respectively. The claim of the petitioners is that their salary has been incorrectly fixed. The petitioners have represented to the respondents authorities in regard to the correction of their pay scales. The contention of Sri P.R. Maurya, learned counsel for the petitioners is that the representation of the petitioners has not been decided till date. He also contends that the controversy stands covered by the judgement of this Court rendered in the case of Dharampal Singh Rajpoot and others Vs. State of U.P. and others, registered as Civil Misc. Writ Petition No.10665 of 2006.
Sri Deepak Verma, learned Additional Chief Standing Counsel states that the issues raised by the petitioners are factual in nature which need to be verified by the competent authority in the first instance.
No useful purpose will be served by keeping the writ petition pending. By consent of the parties, the writ petition is being finally disposed of.
The matter is remitted back to the respondent No.2-Director of Education Madhyamik, U.P. Allahabad. A mandamus is issued to the respondent No.2 to decide the representation of the petitioners regarding the correction of their pay scales and grant of other salary benefits. The representation shall be decided in accordance with law expeditiously, preferably, within a period of four months from the date of production of a certified copy of this order along with the fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
