Heard learned counsel for the applicant and learned A.G.A. for the State.
By way of the instant application, the applicant has prayed for a direction to the trial court to decide Complaint Case No.1730 of 2008, under Sections 7/16 Prevention of Food Adulteration Act, 1954, State of U.P. Vs. Sushil, Police Station Gulabthi, District Bulandshahr, pending in the court of the Additional Chief Judicial Magistrate, Court No.1, Bulandshahr expeditiously.
In this case, the applicant wants expeditious disposal of the aforesaid case.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C. Therefore, no order need be passed by this Court.
Consequently, this application is disposed of.
