Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"I. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2/ District Magistrate, Azamgarh decide the case No.01011 of 2018 Computerized Case No.D201815060001011 (State and another Vs. Ram Janam and another) under Section 128 U.P. Revenue Code, 2006 within stipulated period, which is pending before him since 2018."
Petitioner's application for cancellation of a lease granted in favour of the respondents is stated to be pending since the year 2018.
Perusal of the order sheet reveals that as on date, cognizance on this application has not yet been taken. It appears that the matter is being fixed for considering the question of its maintainability.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, District Magistrate, Azamgarh to consider the issue of maintainability and dispose it of by a reasoned and speaking order within a period of eight weeks from the date a certified copy of this order is filed before him.
