This anticipatory bail u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Sushil Sharma, involved in Case Crime No.133 of 2019, under section 364 I.P.C., Police Station- Awagarh, District- Etah.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It appears that the husband of first informant has been abducted who is still traceless. The details of allegations are there in the F.I.R. which include the allegation against the applicant that through his instrumentality on previous occasions attempt were made to call the abductee away from his home. It appears to be a very serious matter and even this much not known whether the abducted person has been eliminated or is still alive. The availability of the accused and their interrogations appear to be very essential for the purposes of successful investigation.
Without expressing any opinion on the ultimate merits of the case, after considering the submissions advanced, this court is of the view that in the wake of the nature and gravity of the accusation and material in support of the same, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
