JUDGMENT / ORDER

Sushil Kumar S/o Shankarlal Chaudhari . Petitioner/Accused No.1 AND The State of AP., Rep by its Public Prosecutor, High Court of AP., Hyderabad . Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant bail to the petitioners/ Accused No.1 and 2 in the event of his arrest in Connection with FIR No.515/2013 on the file of the Station House Officer, IV Town Police Station, Visakhapatnam, in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri G. Rama Gopal, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“This criminal petition is filed under Section 438 Cr.P.C. seeking anticipatory bail to the petitioner – A1 in connection with Crime No.515 of 2013 of IV Town Police Station, Visakhapatnam, registered for the offences punishable under Sections 417, 420, 468, 471 r/w Section 34 IPC.
Heard the learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent- State.
The allegation of the complainant against the petitioner is the creation and tampering with the link document which was used as one of the document tracing the title of the property purchased by the petitioner for obtaining loan from the bank. The bank had already initiated proceedings under Securitization Act and the involvement of the petitioner is yet to be established. Petitioner is suffering from chronic liver disease requiring liver transplantation and constant medical advice. In those circumstances, it is a fit case to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed and the petitioner - A1 shall be enlarged on bail in the event of his arrest on condition that he executes a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each to the satisfaction of the Station House Officer, IV Town Police Station, Visakhapatnam.
