Sushil Kumar vs The District Magistrate, Hardoi ...

High Court Of Judicature at Allahabad|12 December, 2012

JUDGMENT / ORDER

Hon'ble Virendra Kumar Dixit,J.
Order (Oral) We have heard learned counsel for parties and perused the pleadings of writ petition.
Admittedly, the petitioner was granted loan in the year 2010. Out of the loan amount applied for namely Rs.6 lacs, petitioner was paid the loan of Rs.4,50,000/- only, for, he did not provide receipt of purchase of articles, where for, the loan had been granted, and also did not get the same verified. That is why, the last instalment of Rs.1,50,000/- was not paid by the Bank. It is admitted that the petitioner has only paid a small instalment of Rs.10,000/-.
During the course of hearing the petitioner prayed for grant of liberty to pay the amount by way of easy instalments. It is a loan granted by Bank of India, a nationalised bank, being run with public money. Thus, we are not inclined to accept the prayer for liberty to return the loan by way of easy instalments. However, we grant one month's time from the date of receiving a copy of this order for one time settlement between the parties and for return of the amount.
Writ Petition is dismissed with aforesaid directions.
