The prayer made in the instant petition is for issuing direction to the Executing Court to decide Execution Case No. 17 of 2017 within a specified time frame.
The execution case in question has been registered on the basis of execution application filed by the petitioner for execution of the decree passed in Original Suit No. 1978 of 2011.
A perusal of the order sheet reveals that judgment debtor has already entered appearance in the proceedings and is contesting the same.
Having regard to the fact that the execution case is pending since the year 2017, the instant petition is disposed of with direction to the Executing Court to ensure expeditious disposal of the execution proceedings by fixing short dates and without granting unnecessary adjournments, provided there is no legal impediment.
