Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner is before this Court for a direction to Additional Civil Judge (S.D.), Aligarh/respondent no.1 to decide the application (Paper No.33 Ga) filed in the Original Suit No.978 of 2016 (Smt. Vimlesh Devi Vs. Sushil Kumar and others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional Civil Judge (S.D.), Aligarh/respondent no.1 to consider and decide the aforesaid case/suit in accordance with law expeditiously and preferably within a period of four months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties Order Date :- 6.1.2021 Pramod Tripathi
