1. The present writ petition has been filed against the order dated 17.11.2016 passed by the Commissioner, Kanpur Division, Kanpur rejecting the appeal filed by the petitioner against the order dated 16.09.2015 by which, the petitioner's application for grant of fire arm license was rejected.
2. Though learned counsel for the petitioner submits that the ground for rejection of the application as confirmed in appeal are erroneous and the petitioner is entitled to grant of fire arm license, however, it is undisputed that in the meanwhile, Arms Rules, 2016 have been enforced which would require fresh compliances to be made in accordance with that law.
3. Therefore, no useful purpose would be served in making any further discussion on the exact merit of the case in view of the order proposed to be passed.
4. Accordingly, the present writ petition is disposed of with a direction in the event, the petitioner files a fresh application for issue of fire arm license under the Arms Rules, 2016 within a period of three weeks along with a certified copy of this order from today, the same may be dealt with and decided strictly in accordance with law, as expeditiously as possible, keeping in mind the timelines prescribed under the Arms Rules, 2016 without being influenced by earlier rejection of the petitioner's application that forms the subject matter of the present writ petition.
