Petitioner claims to have appointed on a Class-IV post in the institution concerned. His grievance is that his appointment is not being granted financial approval on account of which his salary etc. has not been released. A representation made in that regard has also remained pending.
While entertaining the writ petition, time was allowed to Sri Rohit Pandey, learned counsel appearing for respondent University to obtain instructions on the question as to whether Statute was amended prior to petitioner's appointment and whether the appointment itself was impermissible. Specific instructions in that regard have not been received so far.
In the facts and circumstances of the case, it would thus be appropriate to dispose of this petition, requiring the Regional Higher Education Officer to examine the grievance of petitioner by passing a reasoned order, within a period of three months from the date of presentation of certified copy of this order .
The question of legality of petitioner's appointment is specifically left open to be examined by the authority concerned, at the first instance.
