The petitioner is a constable and is aggrieved by the order of transfer dated 14.12.2017 by which the petitioner has been transferred from Gautambuddh Nagar to Kannauj. The allegation of the petitioner is that he has been transferred under political pressure on the recommendation of an M.L.A. of Agra.
Transfer is an exigency of service, as such I am not inclined to interfere with the same.However, in case a particular order of transfer causes any personal hardship to the employee, it is always open for him to approach the higher authority. The higher authority in this case is respondent no.2. In case the petitioner makes a representation to respondent no.2, the same may be considered and decided in accordance with law within one moth from the date of filing a representation along with a certified copy of this order. For a period of one month, the order of transfer dated 14.12.2017 shall not be given effect to. The writ petition is accordingly disposed of.
