This application under Section 482 of Cr.P.C. has been filed with the prayer to quash the charge sheet no. 1 of 2019, dated 28.5.2019 submitted in Case Crime No. 219 of 2019, under Section 504 I.P.C., P.S.- Kotwali, District- Etawah, as well as cognizance order dated 2.9.2019 taken by the C.J.M., Etawah.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicant has not been able to point out any such infirmity in the proceedings which may indicate that the court below has not proceeded in accordance with law in the case. In such circumstance, this application disposed of by making observation that the court below shall look into the matter and see that if the charge sheet has been submitted under non cognizable offence then it should proceed in the case keeping in perspective of Section 2(d) of Cr.P.C.
With the aforesaid observation this application stands disposed off.
