The petitioner has assailed the order dated 31.05.2019 passed in Case No. 01109 of 2019, Sushil Chandra Bansal Vs. M/s Vailly Promoters Ltd. and others, pending before the learned Additional Commissioner (Judicial)-IV, Meerut Division, Meerut under Section 207 of the U.P. Revenue Code, 2006.
By the order dated 31.05.2019 passed by learned Additional Commissioner (Judicial)-IV, Meerut Division, Meerut, the interim order granted on 24.05.2019 has been recalled.
Learned counsel for the petitioner submits that the order assailed in the instant writ petition is not a reasoned order.
In opposition, Sri Nitin Sharma, learned counsel for the respondent no. 4 contends that the interim order itself is bereft of reasons. He calls attention to the order.
Learned counsel for the petitioner could not dispute the fact that the interim order dated 24.05.2019 was not a reasoned order.
I find merit in the submission of Sri Nitin Sharma, learned counsel for the respondent no. 4. The order dated 24.05.2019 is illegal and arbitrary, inasmuch as, it is completely bereft of reasons. The order dated 24.05.2019 reflects non application of mind. No prejudice to the petitioner is caused by recalling the interim order which itself was arbitrary and illegal.
The writ petition is dismissed.
