Petitioner applied for appointment to the post of Asha Karyakarti and the grievance is that though she has been selected but appointment has not been given to her, instead respondent no. 5 has been sent for training.
While entertaining the writ petition time was granted to the learned Standing Counsel to obtain instructions in the matter.
Dr. A.N. Singh, learned Standing Counsel points out that Writ Petition No.1589 of 2018 was initially filed by the petitioner in which a direction was issued to get the matter revolved by the Grievance Redressal Committee. The District Magistrate constituted a committee which submitted its report on 21.10.2018 as per which the selection was not on the basis of merit in the open general meeting and selection itself was vitiated. A decision was taken to get the fresh selection conducted but event thereafter the proceedings have not been undertaken as per law and a fresh order has been passed on 1.10.2020 for getting fresh selection proceedings conducted in accordance with the government order. It is also stated that the respondent no. 5 was previously sent for training on 26.12.2017 to 2.1.2018 but the selection proceedings ultimately have not been approved.
In view of the stand so taken by the respondents, it would be appropriate to direct the concerned authorities to undertake fresh exercise for recruitment in accordance with the government order. Needless to state that the petitioner would also be permitted to take part in the proceedings for selection. Such proceedings would be undertaken within a period of four months from the date of presentation of copy of this order.
Subject to the observations made above, this petition stands disposed off.
