This bail application has been moved on behalf of the applicant accused-Susheel @ Pintoo @ Bangali , who is involved in Case Crime No. 111 of 2010, Under Section 8/20 of N.D.P.S. Act, Police Station- Sardhana, District- Meerut.
Heard learned counsel for the applicant, learned AGA and perused the record.
The applicant is said to have been arrested by the police with 150 gm. Charas on 20.2.2010.
It is contended that the applicant is innocent. He was neither arrested as alleged nor any thing was recovered from his possession. The alleged recovery is fake. The applicant is in jail for more than ten months, therefore, in the aforesaid facts and circumstances, the applicant is entitled for bail.
Learned AGA opposed the bail application and submits that the applicant accused has a criminal history, therefore, he is not entitled for bail.
Considering the submissions of learned counsel for the parties, the quantity of alleged recovered charas and the fact that the applicant is in jail for the last more than ten months, without expressing any opinion on the merits of the case, I consider it a fit case for bail.
Let the applicant- Susheel @ Pintoo @ Bangali involved in the aforesaid case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
