An order of suspension dated 19th March, 2019 is assailed in this petition, whereby petitioner has been placed under suspension. The charge against petitioner is that instead of ensuring deposit of the electricity dues the petitioner in collusion with the customer has facilitated opening of a fresh connection. Other allegations have also been made in that regard.
The order is assailed on the ground that charges are vague and do not constitute a definite basis to proceed departmentally against the petitioner.
Sri Kapil Dev Singh Rathore appearing for the respondents points out that a chargesheet has already been served upon the petitioner on 9th May, 2019. Copy of the chargesheet has also been furnished to the counsel for the petitioner today in Court.
In the facts and circumstances, since a chargesheet has already been served upon the petitioner, it would be appropriate to dispose of this writ petition by permitting the petitioner to submit his reply, alongwith certified copy of this order, within two weeks from today. If the petitioner does so, the disciplinary enquiry would be concluded within a further period of two months, thereafter.
Writ petition, accordingly, stands disposed of.
