Heard learned counsel for the applicants and learned AGA for the State.
This application has been filed by the applicants with a prayer to quash the charge sheet dated 13.2.2021 and 22.3.2021 as well as entire proceedings of Case No. 389 of 2021 (State of U.P. Vs. Susheel Kumar Singh and others), arising out of Case Crime No.0022 of 2021, under Sections 147, 148, 149, 323, 504, 506, 452, 427, 325 IPC and Section 3(2) (Va) of SC/ST Act, Police Station Holagarh, District Prayagraj, pending in the court of Chief Judicial Magistrate, Prayagraj.
After advancing his argument at some length, learned counsel for the applicant gave up his challenge to the impugned charge sheet dated 13.2.2021 and 22.3.2021 and made a prayer that a direction be issued to the court below to consider and decide the bail application of the applicants expeditiously in accordance with law. He further submitted at the Bar that he is not pressing any other prayer made in the application.
In view of above, relief as prayed in the application is refused.
However, considering the prayer made by learned counsel for the applicants, it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail, the same shall be heard and disposed of expeditiously by the courts below.
With the above directions, this application is disposed of finally.
