Sri Ashutosh Srivastava, learned counsel for petitioner, after arguing for some time, prays for withdrawal of this petition, as he proposes to file an application to the concerned court of learned Chief Judicial Magistrate, Gorakhpur with a list of the properties of the accused, to be attached in a proceeding under Section 83 Cr.P.C.
On his request, it is directed that in case, a list of properties is provided by the complainant to the concerned court, then concerned court may, if deemed proper, proceed in the matter, as per the provisions contained in Section 83 Cr.P.C.
With above observation, petition is disposed off.
