Counter affidavit filed by the Standing Counsel is taken on record.
The present writ petition has been filed praying for a writ of mandamus commanding the revenue authorities to remove the alleged encroachment made by respondent nos. 6 to 10 over Plot No. 406 which the petitioner alleges to be Gaon Sabha property and which is recorded as pond in the revenue records.
In the counter affidavit sworn by the Tehsildar, Karchhana, District Allahabad, it has been stated that after due investigation by the revenue team, no encroachment was found over the aforesaid plot. A report to the said effect and photographs showing that no encroachment exists over Plot No. 406 has been annexed with the counter affidavit.
In view of the aforesaid statement given in the counter affidavit, no further orders are required to be passed in the present public interest litigation.
With the aforesaid observations, the writ petition is disposed of.
