O R D E R:
Heard learned counsel for the petitioner and learned standing counsel for the first respondent.
2. Since notices were not served on respondents 3 to 6, the writ petition was dismissed for default as against those respondents by virtue of Court Order dated 24.06.2011.
3. The case of the petitioner is that respondents 2 to 6 are residing in premises No.13-2-757 as tenants and they want to grab an extent of 800 square yards situated in front of the house bearing No.13-2-757/3. The said land is earmarked for park. Since respondents 2 to 6 were trying to grab that land, the petitioner society submitted a representation to the first respondent marking a copy to the Secretary, Municipal Administration, Hyderabad. When there was no response, the present writ petition was filed.
4. Even after 7 years, no counter-affidavit is filed by the first respondent.
5. In view of the nature of the relief sought in the writ petition, this writ petition is being disposed of without a counter-affidavit from the first respondent. The first respondent is directed to consider the representations dated 08.12.1997 and 05.09.2000 filed by one B. Hanumanthu in respect of the land an extent of 1000 square yards earmarked for construction of a community hall at Kagaziguda (Circle No.4) and take necessary action in accordance with law and communicate a copy of action taken to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
