ORDER:
This Civil Revision Petition arises out of order dated 21-12-2013 in C.M.A.No.86 of 2012 on the file of the learned Special Sessions Judge for trial of cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989-cum-Additional District and Sessions Judge, Ranga Reddy District, whereby he has confirmed order dated 2-4-2011 in I.A.No.1097 of 2010 in O.S.No.645/2010 on the file of the learned VIII Additional Senior Civil Judge, Ranga Reddy District at L.B. Nagar.
The petitioner filed the above mentioned suit for specific performance of agreement of sale. Pending the suit, the petitioner filed I.A.No.1097 of 2010 under Order 39 Rules 1 and 2 r/w. Section 151 CPC for ad interim injunction restraining the respondents from alienating or transferring in any manner the suit schedule property, pending the suit. By detailed orders, both the Courts below have dismissed the said I.A.
On a careful consideration of the reasons given by both the Courts below, I am of the opinion that no case is made out by the petitioner for interference with the orders of the Courts below. It is needless to observe that any alienation of the suit schedule property made by the respondents during the pendency of the suit will be hit by the doctrine of lis pendens and such transactions shall be subject to the result of the suit.
Subject to the above observation, the Civil Revision Petition is dismissed.
As a sequel to the disposal of the Civil Revision Petition, CRPMP No.3116 of 2014 filed for interim relief is disposed of as infructuous.
