JUDGMENT / ORDER

The petitioner has filed the present petition for a direction to the respondent No.1 to recover an amount of Rs.3,50,000 from respondent No.2 and to pay the same to the petitioner and for other consequential reliefs.
It is informed that against the order dated 28.11.2011 passed by the Controlling Authority under the Payment of Gratuity Act, 1972 an appeal is preferred and the same is fixed on 7th May 2012. Hence, it will not be appropriate to entertain the present petition. However, the appellate authority is directed to expedite the hearing of the appeal and decide the same within one month from the date of receipt of order of this Court as the petitioner has already been superannuated.
With the aforesaid observations and directions petition stands disposed of.
It is clarified that this Court has entered into the merits of the matter and the petitioner is at liberty to challenge the order of the appellate authority if the same is adverse to the petitioner.
Direct Service is permitted.
