Heard learned counsel for the petitioners; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 27th November, 2019 registered as Case Crime No.143 of 2019, under Sections 379 and 411 IPC and Section 2/3 of Prevention of Damage to Public Property Act, 1984 at Police Station Poonch, District Jhansi.
The allegations in the impugned first information report though lodged against unknown persons disclose the act of illegal mining and theft of minerals. Under the circumstances, the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail/anticipatory bail, as may be advised.
