JUDGMENT / ORDER

Writ petitioner-appellant, aggrieved by order dated 7.1.2010 passed by a learned Single Judge in Civil Misc. Writ Petition No. 71134 of 2009, has preferred this appeal under Rule 5 Chapter VIII of the High Court Rules.
Writ petitioner-appellant (hereinafter referred to as 'appellant'), aggrieved by the order of suspension dated 3.12.2009, preferred the writ application. He was suspended on the ground that a criminal case had been instituted against him. It was contended on his behalf that as his arrest has been stayed in a writ petition, he ought not to have been put under suspension. This did not find favour with the learned Single Judge and he dismissed the writ application.
Mr. S.P. Sharma, appearing on behalf of the appellant, submits that petitioner has been suspended without approval of the Assistant Registrar and that having not been done, the order of suspension is vitiated.
No such plea was raised before the learned Single Judge. Further, from the order impugned, it seems that it is on the recommendation of the Assistant Registrar that he was put under suspension. The learned Single Judge while dismissing the writ application has directed for expeditious disposal of the inquiry.
We are of the opinion that the learned Single Judge rightly did not interfere with the order of suspension.
We do not find any merit in the appeal and it is dismissed accordingly.
