Petitioner claims that he is entitled to be appointed on the post of Constable (GD) pursuant to recruitment exercise initiated by the Commission in the year 2011. It appears that in respect of his grievance, petitioner had approached this Court by filing Writ Petition No.1641 of 2013, which came to be disposed of 11.1.2013, directing the Commission to examine petitioner's claim. Such claim of petitioner was examined vide order dated 19.5.2017, in which it was mentioned that petitioner has scored marks below the cut-off, and therefore, no relief can be granted to him.
Learned counsel for the petitioner submits that choice of force was not indicated as per the respondents, and certain column were left blank and that is why he was not selected. Submission is that it was an inadvertent error and petitioner ought not to have been victimized.
Sri Sabhajeet Singh, learned counsel appearing for the authorities of the Union of India submits that claim of petitioner already stands rejected vide order dated 19.5.2014, which has also attained finality and has not even been challenged in this petition, and as such no relief can be granted.
Neither the order dated 19.5.2014 is challenged, nor there is any explanation as to why petitioner has approached this Court after such long lapse of time, particularly when the recruitment exercise was initiated in 2011 and concluded long back. Even otherwise, this Court finds that petitioner has scored 48 marks while the cut-off in the unreserved category is 62 marks.
Writ petition is, accordingly, dismissed.
