Heard learned counsel for the petitioner and Shri Manoj Kumar Yadav for the Gaon Sabha.
Petitioner complains of unauthorized encroachment upon plot no.792/1638, which is stated to be recorded as rasta in the revenue records.
Learned counsel for the petitioner also admits that the proceedings for eviction of the unauthorized occupants under section 67 of the U.P. Revenue Code, 2006 have already been instituted.
The petition is disposed of with the observation that the proceedings under Section 67 of the U.P. Revenue Code, 2006 drawn upon encroachers be decided by the Assistant Collector -Ist Class, respondent no.2, expeditiously and preferably within a period of three months from the date a certified copy of this order is filed before him.
