Learned counsel for the petitioner contends that under Annexure-5, the resolution, petitioner withdrew money which was payable by the respondents as salary of the petitioner. Impugned order has been passed without giving show cause notice to the petitioner and recovery is sought to be made for the said amount.

Sri Pankaj Patel, learned Government Advocate, undertakes to file reply/counter affidavit on behalf of the respondents within a period of three weeks.

Rejoinder affidavit, if any, be filed within two weeks thereof.

List on 29.10.2012.

In the meantime, recovery from the petitioner shall remain stayed.
