Heard learned counsel for the petitioner, learned Additional CSC for the State and Shri Rakesh Chaudhary learned counsel who has appeared for State Election Commission through video conferencing.
The result of the election has already been declared on 04.05.2021. Learned counsel for respondents has submitted that the petitioner as against the grievances raised in the petition has an efficacious and alternate remedy under Section 27(2) of Uttar Pradesh Kshetra Panchayat and Zila Panchayat Adhiniyam 1961, hence the present writ petition cannot be entertained for adjudication of issues which are factual in nature.
The writ petition is accordingly dismissed with the liberty open to the petitioner to avail the alternative remedy of filing an election petition.
In case any such a petition is filed before the competent authority, it is expected that the same shall be decided expeditiously in accordance with law.
