Heard Brijesh Kumar Chaudhary, learned counsel for the petitioner and Shri Rakesh Kumar Chaudhary learned counsel for the respondents.
As per instructions dated 29th of August, 2019, Civil Suit No.T-201904040103375, Civil Suit No.T-201904040103376, Civil Suit No.T-201904040103085, Civil Suit No.T-201904040103084, Civil Suit No.T-2019040401403083 and Civil Suit No.T-201904040103082 in respect of various gata numbers as stated in the writ petition is pending before the Deputy Collector under Public Premises Act for eviction of unauthorized occupant.
As the matter is pending before the competent court, therefore, no direction could be issued in this matter. The authority has already initiated proceedings for removal of unauthorized occupant and number of petitions are pending in respect of various gata numbers.
Since the number of civil suits are pending before the Deputy Collector, hence there is no need to pass any further order in the matter. Accordingly, the writ petition is dismissed.
