The petitioner who happens to be dependent of late Shail Kumar Pandey, who was an Assistant Teacher in Janta Janardan Inter College, Gandhi Nagar, Ghazipur, appears to be aggrieved by non-consideration of his appointment on compassionate ground after the death of his father.
In the submissions of the learned counsel for the petitioner, after the death of father, the petitioner has made an application for appointment on compassionate ground. Pursuant thereto, the District Inspector of Schools sent a letter to the Additional Director of Education (Intermediate) , Directorate, Allahabad, who, as per his letter dated 23.12.2008, directed the District Inspector of Schools, Ghazipur to decide the petitioner's claim in view of the Regularisations 101 to 107 contained in Chapter III of the U.P. Intermediate Education Act, meant for appointment on compassionate ground, but no action has been taken. Hence, this writ petition.
I have heard learned counsel for the petitioner and learned Standing Counsel appearing for respondents.
Considering the facts and circumstances of the case, it is provided that the District Inspector of Schools, Ghazipur/any Committee, constituted under Regulation 106 of the said Regulations, shall consider the petitioner's case for appointment on compassionate ground expeditiously, preferably, within a period of three months from the date of receipt of certified copy of the order of this Court, after hearing the respondent No. 5.
Subject to above observations, the writ petition is disposed of.
