This writ petition arises out of an objection under Section 9-A(2) filed by the petitioner claiming on the basis of a Will in his favour. It is submitted that a second appeal arising out of a civil suit wherein question of validity of this Will is issue, is pending before this Court in Second Appeal No. 313 of 2003.
