Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
The instant writ petition has been filed for the following prayers:-
"(a) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to pass the final order in the case no.2857 of 2021, State vs. Rajpati Yadav and others, under Sections 133 Cr.P.C. as per provision of Section 133 Cr.P.C.
(b) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents i.e. revenue authority and police to remove the construction raised on the Arazi No.557 recorded as Abadi being used as a general path by the petiotioners and residants of Naharpur/Jabradeeh.
(c) Issue a suitable writ order or direction which this Hon'ble Court may pass such order and further order which this Hon'ble Court may deem fit and proper under the fact and circumastances of the case."
Having heard learned counsel for parties and keeping in view the overall facts and circumstances of the case, the present writ petition is finally disposed of with the direction to court concerned to dispose of the aforesaid case expeditiously, preferably within a period of four weeks from the date of production of the certified copy of this order without granting any unnecessary adjournment to the parties, in accordance with law if there is no other legal impediment.
