Heard learned counsel for the accused-appellant and learned A.G.A. for the State.
By means of this application, the applicant, Surya Bhan Karwariya who has been convicted in Sessions Trial No.351 of 2015, arising out of Case Crime no.515 of 1996, under Sections 147, 148, 149, 307, 302/34 I.P.C. and 7 Criminal Law Amendment Act, Police Station Civil Lines, Allahabad, is seeking short term bail.
This appeal was filed by different Advocates. However, looking to the urgency that the marriage of the daughter of the appellant is going to be solemnized on 19.05.2021, this short term parole application has been filed by another Advocate, who has been given no objection by the earlier counsel.
This application has been moved for short term bail on behalf of the accused appellant, Surya Bhan Karwariya on the ground of marriage of his daughter. In support of this application an affidavit has also been filed along with photocopy of the marriage card as Annexure-2 to the affidavit.
Learned counsel for the State has opposed the prayer for parole.
In view of the facts and circumstances of the case, we are inclined to grant parole to the accused applicant-appellant, Surya Bhan Karwariya for performing the marriage rituals of his daughter.
Let the appellant-applicant, Surya Bhan Karwariya be released on short term bail from 13.05.2021 to 05.06.2021 on his furnishing a personal bond of Rs.10 lacs and the applicant-appellant shall positively surrender before the jail authority where he is lodged, on 06.06.2021 at 10:00 A. M.
This order be communicated to the concerned Jailor, where the appellant is lodged and he shall be released.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners along with a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
