Heard Sri Yadvendra Kumar Yadav, learned counsel for the petitioners and learned Standing Counsel representing the respondent no.1.
Present writ petition has been filed beseeching early disposal of Case No.381, 382 (Suruj and others vs. Babban and others) under section 9-A(2) of the Uttar Pradesh Consolidation of Holdings Act, 1953 (in brevity 'U.P.C.H. Act') with respect to the property situated in Village-Charauan, Tehsil-Belthara Road, District-Ballia.
It is submitted by learned counsel for the petitioners that petitioners have moved an application dated 29.12.2020 (Annexure-2) under Section 9-A(2) of the U.P.C.H. Act (Suruj and others vs. Babban and others) with respect to Khata no.1256 and 323. Since the date of its filing, the aforesaid application is pending protracted without getting any fruitful step to get the aforesaid matter finally decided. It is submitted that the Court concerned be directed for early disposal of the aforesaid application.
Learned Standing Counsel has fairly contended that he has no objection if this Court issues a direction for early disposal of aforesaid application.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Consolidation Officer (respondent No.1), before whom the application dated 29.12.2020 (Annexure-2) is pending disposal, to decide the same expeditiously, preferably, within the period of twelve months from the date of receipt of a copy of this order.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observations, present writ petition is disposed of.
