1. By this application, the applicant convict has prayed that he be enlarged on temporary bail to attend the religious ceremony scheduled on 23.4.2012.
2. Pursuant to the earlier order passed by this court, learned APP Mr. Pandya has submitted, on the basis of the instructions which he has received from the Superintendent of Police, Bharuch, that the ground mentioned in the application is genuine.
3. From the jail remarks, we find that whenever the applicant convict was enlarged on temporary bail or was on furlough, he has surrendered to the jail authority in time.
4. By separate application being Criminal Misc. Application No.4759 of 2012, the applicant has moved this Court for temporary bail on the ground of marriage of his sister's son scheduled on 14.4.2012. Since the application is under consideration, considering the fact that on 14.4.2012, there is function in the family, we pass the following order.
(a) It is directed that the applicant shall be enlarged on temporary bail from 13.4.2012 to 26.4.2012 on furnishing personal bond of Rs.5000/- and one surety of like amount.
(b) It is further directed that the applicant shall surrender to the jail authority on 27.4.2012.
5. The application is allowed. Rule is made absolute to the aforesaid extent.
6. Learned APP Mr. Pandya shall communicate this order to the jail authority.
