(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Heard learned Advocate MR. J. M. Buddhbhatti for the appellant, who is convicted by the learned 5th (ad-hoc) Additional Sessions Judge, Sessions Court, Surat in Sessions Case No.108 of 2011 by Judgment and Order dated 27.03.2012. The learned 5th (ad-hoc) Additional Sessions Judge was pleased to convict the appellant guilty for the offence punishable under section 302 of the Indian Penal Code and sentenced him for Rigorous Imprisonment for life.
Learned Advocate for the appellant invited the attention of this Court to the discussion of evidence in the matter and submitted that the learned 5th (ad-hoc) Additional Sessions Judge has committed an error in convicting the accused for the aforesaid offence, more particularly when there is no evidence against him.
The matter requires consideration.
