It is argued by the counsel for the petitioner that when the order dated 20.04.2012 passed in Original Suit No. 410 of 2012 was not complied with an application Under order 39 Rule 2-A was filed by the petitioner on 25.04.2013 which was numbered as Misc. Case No. 41 of 2013 (Sursati Devi vs. Smt. Jasiya & Others). It is further argued that inspite of the fact considerable time has already been lapsed but till date no decision has been taken.
Heard counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notice need not issue to the respondent nos. 2 to 4.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of three months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
