This Court by an order dated 22.11.2016, directed the Registry to list the suit before the Master for recording exparte evidence within three weeks and the suit was listed before the Additional Master I, on 23.12.2016, 12.01.2017, 19.01.2017, 20.01.2017 and 23.01.2017, the plaintiff has not produced any evidence. The docket order dated 23.01.2017, shows that no representation for the plaintiff till 1.25pm, plaintiff also not appeared, time granted by the Court expired, the suit was referred to this Court. The suit is listed today, even today, also there is no representation on the side of the plaintiff either in person or through his counsel. Despite sufficient opportunity given to the plaintiff for let in exparte evidence, the plaintiff has not chosen to examine any witness and for marking any documents. Therefore, the suit is dismissed for non prosecution. No costs.
