Shri.Sanjay Kumar Pandey, learned counsel appearing on behalf of the petitioner submits that the petitioner is an old lady of 82 years and is one of the defendants in Suit No.184 of 2017, (Smt.Kabutari Devi & Ors. Vs. Smt.Surji Devi & Anr), which is pending before Civil Judge (Junior Division), Gorakhpur and prayed that the aforesaid suit may be expedited.
He further submits that the said suit is pending since 2017 and an order of temporary injunction is in operation against the defendants. He further submits that after 29.1.2018, no much proceeding has taken place in the aforesaid suit.
Considered the submissions made at bar and perused the record.
This writ petition stands disposed of with the direction upon the learned court concerned that the court concerned shall take all endeavor to expedite the proceedings of the Suit No.184 of 2017, (Smt.Kabutari Devi & Ors. Vs. Smt.Surji Devi & Anr), and decide the same at the earliest in the light of the judgment passed by the Hon'ble Supreme Court in the matter of M/s. Shiv Cotex Versus Tirgun Auto Plast P. Ltd and others 2011 (89) ALR, 232, without granting any unnecessary adjournment to either of the parties.
