Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition has been preferred seeking issuance of a direction commanding the respondents to appoint the petitioner on the post of Constable. According to the learned counsel, although the petitioner has successfully completed all formalities and his name was also mentioned in the list of candidates to be sent for training, no further steps for his appointment have been taken on account of the pendency of Criminal Case No. 188 of 2015. Learned counsel submits that in the said criminal case although a charge sheet has been filed before the competent court against other accused, the Investigating Officer has specifically recorded that no evidence has been found so as to implicate the petitioner in the commission of this crime. In view of the aforesaid, it was contended that no legal impediment existed in the appointment of the petitioner. Learned counsel for the petitioner has additionally placed reliance upon the decision of the Supreme Court in Avtar Singh Vs. Union of India And Others, 2016 (8) SCC 471 to submit that no justifiable cause existed for denying appointment to the petitioner.
Learned Standing Counsel states that the third respondent shall duly evaluate and consider the claim of the petitioner and dispose it of in accordance with law within a period of one month from the date of presentation of a certified copy of this order along with a copy of the writ petition.
In light of the statement so made, which is recorded and accepted, nothing further survives on this petition, which shall in consequence stand disposed of.
