Order in the First Appeal:
Learned advocate Mr. Sanghavi for the appellant placed on record the instructions received from the appellant stating that as the amount of premium with the revenue authority has not been decided, present first appeal may be permitted to be withdrawn. Learned advocate has stated that without prejudice at this stage the appeal may be permitted to be withdrawn. Permission to withdraw the appeal is granted. Present appeal stands disposed of as withdrawn with a liberty to file appeal after the revenue proceedings are over. Since the matter is withdrawn at this stage, the permissible court fees refund may be granted on usual terms.
Order in the Civil Application:
In view of order passed in the First Appeal, the Civil Application stands disposed of.
