JUDGMENT / ORDER

The petitioner is the holder of building permit for constructing a residential building.
2. In view of the Government Order, the petitioner does not require permit for extracting ordinary earth from the site covered by the building permit. However, for the purpose of transporting ordinary earth, the petitioner requires 'P form'.
Therefore, there shall be a direction to the third respondent-Geologist to issue necessary 'P form’ after ascertaining any quantity to be removed for constructing a residential building. Needful shall be done within a period of ten days from the date of receipt of a copy of this judgment without insisting for No Objection Certificate or Environment W.P.(C) No.32017 of 2014 2 Clearance. However, it is made clear that if the petitioner fails to construct any residential building pursuant to Ext.P1 permit, it can be concluded that it was obtained to defraud the authorities and necessary action shall be taken against the petitioner under the Mines and Minerals (Development and Regulation) Act, 1957.
The writ petition is disposed of as above.
